Trademark Specimens: Requirements and Common Problems

A specimen is evidence of how a mark is actually used with the relevant goods or services. The form of evidence and its context matter. A logo file, mockup or digitally altered product image should not be assumed acceptable.

Begin with the real offer

Identify whether the application concerns goods, services or both. Review how the customer encounters the mark in ordinary commerce. Evidence for a product can differ from evidence for a service, even when the brand name is the same.

Goods and services need appropriate context

Product labels, packaging and certain displays can be relevant to goods. Service evidence should show the required association between the mark and the identified services. These are starting categories, not a promise that any particular item will be accepted.

Webpage evidence needs more than a screenshot

A webpage must contain the context required for the relevant type of specimen. Current USPTO guidance addresses webpage URLs and access or print dates. Review what the page actually shows and preserve accurate context rather than adding unsupported details later.

Keep evidence truthful

Do not create synthetic packaging, paste a mark onto an image or invent a sale or use date to cure a problem. A substitute specimen must satisfy the applicable requirements and be supported by genuine facts. The date of use can matter to the available response route.

Read the actual refusal

An examiner may question association with the goods or services, the mark shown, ornamental presentation, timing or other requirements. Read the precise concern before choosing new evidence. Replacing a file is not automatically a sufficient response.
