Read the registration record
Gather the registration number, owner, registration date and current official status. A canceled registration presents a different problem from an upcoming maintenance window. Ownership changes and the actual goods or services still in use also need review.
Understand the forms
Section 8 addresses continued use or qualifying excusable nonuse for applicable registrations. Section 9 is the applicable renewal application. Section 71 addresses U.S. use declarations for Madrid-based registrations. International registration renewal through WIPO is a separate matter.
Optional incontestability is not maintenance
Section 15 is an optional declaration subject to its own requirements. It does not replace required filings and should not be presented as making a mark immune from every challenge. Review whether it is appropriate for the actual registration.
Confirm the relevant window
Filing windows and any grace period depend on the registration and filing. Use current official guidance and the actual registration date and basis. A missed window can have serious effects; do not assume a petition will recreate a canceled registration.
Evidence and coverage must be accurate
Review the listed goods or services and genuine current use evidence. Required filings should not retain items merely because they were originally registered. Any excusable-nonuse claim requires the relevant factual and legal assessment, not a routine checkbox.
Separate ongoing services
Monitoring, reminders, maintenance preparation and enforcement are different tasks. Confirm which ones your engagement covers and which government fees apply. Keep your own records even if a third party offers reminders, and verify suspicious renewal solicitations against the official record.
