What Is a Trademark Office Action?

An Office Action is a USPTO notice identifying an issue with a trademark matter. Verify the official notice, read every refusal or requirement, and determine the correct response route and deadline from the actual record.

Verify the notice

Locate the application in TSDR and compare the notice with the official documents. A third-party solicitation is not an Office Action. Keep the serial number, issue date and the full notice available for review, and avoid relying only on a summary in an email.

Separate requirements from refusals

A notice can address owner information, identification, disclaimers, specimens or substantive refusal grounds. Some narrow issues are different from disputed legal questions. Identify every point that requires action instead of assuming one standard response will resolve the matter.

Non-final and final notices

A non-final notice raises matters for a response. A final notice maintains unresolved issues after earlier examination and can involve different procedural choices. Review the prior response and current record before selecting a service.

Use the actual response period

Deadlines vary with notice type and filing basis. Extensions may be available in some situations, subject to requirements and fees. Contacting a service provider or submitting a quote request does not stop the USPTO deadline.

Final-action choices need careful review

Reconsideration and appeal are distinct procedures. A request for reconsideration should not be treated as extending an appeal deadline. Qualified review of the record, issues and timing may be appropriate before deciding how to proceed.

Choose focused help

Use the Non-Final or Final Office Action service page for your notice. For a notice involving a Statement of Use, select that specialist service. For an already abandoned application, request an abandonment review. Share basic public record details first and agree on scope and fees before work begins.
